If you die without a will (intestate), a court must appoint an administrator to handle your estate, and your assets will be distributed according to your state's intestate succession laws, prioritizing close family members like your spouse, children, parents, and siblings, rather than your specific wishes. The court-appointed administrator will manage the estate through a probate process, which can be a lengthy and complex court procedure.
Who handles your assets?
A Court-Appointed Administrator: Since there's no will naming an executor, the court must appoint an administrator to manage your estate.
Order of Priority: California law (and most other states) provides a statutory priority list for who can be appointed administrator. This typically follows this order:
Surviving spouse or domestic partner
Adult children
Parents
Siblings
Court Decision: A judge will decide who among eligible individuals will be appointed. Conflicts can arise, and the court may hold hearings to determine the most suitable candidate.
What happens to your assets?
Intestate Succession Laws: Your assets are distributed according to state law, not your personal preferences.
Family-First Approach: The state's laws prioritize close family members. In California, this generally means your surviving spouse inherits a portion, and the rest is divided among your children. If there's no spouse, assets go to children, then parents, then siblings, and so on.
Court-Supervised Probate: A probate process is required to administer and distribute the estate.
Frozen Assets: Until the court issues formal letters of administration, no one has legal authority to access the deceased's accounts or assets, which can lead to immediate financial hardship for the family.
Delays and Costs: The probate process can be lengthy, taking months or even over a year, especially if there are disputes. It can also reduce the size of the estate due to associated costs.
How to avoid this:
Estate Planning: To ensure your assets go to your chosen beneficiaries and to simplify the process, it is best to create a will and other estate planning documents.
Beneficiary Designations: Assets like those in retirement or bank accounts can avoid probate by having named beneficiaries.
Joint Ownership: Consider joint ownership of assets with a spouse or other individuals to facilitate a smooth transfer of property.

你copy 了这么多,就没读一下么?
prioritizing close family members like your spouse, children, parents, and siblings, rather than your specific wishes
court appointment 就是过一个程序,一般就是按顺序走next of the kin.
对于家庭关系简单的华人家庭,基本就是走配偶-成年子女-父母(绿卡美籍)这个track. 所以对孩子还成年的,设立trust及其重要
